2008 Legislative

During the 2008 Legislative Session, HB 803 was passed, regarding the closure of examination application files for individuals who have not completed licensure requirements within 24 months.

HB 803 amended Section 490.005, Florida Statutes, to include the following clause regarding timeframes for completion of the requirements for psychologist licensure:

490.005 Licensure by examination

(3)(a) The board shall close the application file of any applicant who fails to pass the psychology licensure examination and the Florida law and rules portion of the examination or who fails to submit evidence of completion of the postdoctoral, supervised experience within a timeframe no longer than 24 months.

The new law took effect on January 1, 2009. New applicants, as of January 1, 2009, will have two years, from the date of notice that the licensure application has been approved by the Board, to complete licensure requirements.

In addition, the Board determined, during its October 2008 General Business meeting, that all current applicants will have two years from January 1, 2009 to complete any outstanding requirements.

Rule 64B19-11.0075, F.A.C., Application Closure after 24 Months, became effective January 26, 2009 to implement the new law:

64B19-11.0075 Application Closure After 24 Months.

(1) The Board shall close the application file of and issue a final order of denial to any applicant for licensure by examination who fails to pass the Examination for Professional Practice in Psychology and the Florida laws and rules examination or who fails to submit evidence of completion of the postdoctoral, supervised experience within 24 months of the issuance of the Board´s letter advising that the applicant has been approved for examination. (2) The Board may grant an additional twelve (12) months to comply with the requirements of subsection (1) above, of up to 36 months, to any applicant who files a written request for extension and demonstrates that the applicant has made a good faith effort to comply but has failed to comply because of illness or unusual hardship.

2006 Legislation

GOVERNOR SIGNS INTO LAW 4 BILLS AFFECTING PSYCHOLOGY LICENSEES
THE BILLS: Effective July 1, 2006

BILL #1. HB 587- amends section 456.072, F.S. -Relating to Health Care Practitioners/Licensees: All health care licensees must provide notice to patients of what type of license the health care provider has (e.g., Psychologist, Medical Doctor, Dentist, ARNP, Physician Assistant, Dentist, etc):

  • A name tag meets the requirement,
  • An oral notice to patient meets the requirement,
  • Advertisement must include this notice as well,
  • Exemptions apply to Chapter 394, 395, and 400 facilities, and
  • Boards may promulgate rules to further define compliance with the statute.

BILL # 2. HB 699-amends sections 456.031, F.S.; section 456.033, F.S.; section 456.041, F.S. and additional statutes- Relating to Health Care Practitioners:

Continuing education requirements for psychology licenses changed as follows:

  • Domestic Violence CE is no longer required for initial licensure,
  • Domestic Violence CE is now a 2-hour requirement every third renewal. For example, if you renewed your license on May 31, 2008, you are required to complete the Domestic Violence CE before the May 30, 2012 renewal.

BILL # 3. HB 775- creating section 490.0149, F.S. -An Act Relating to Health Care Practitioners: Bill requires the Board of Psychology to draft a rule to establish criteria for the approval of certifying bodies that provide certification for specialties in psychology.

BILL # 4. SB 1408 - amends sections 456.057, F.S.; section 456.42, F.S.; section 456.43, F.S. and additional statutes- Relating to Medical Records

  • Defines the term "records custodian."

CE Broker Information for Providers and Licensees - Licensees may subscribe now and receive the personal benefits of continuing education tracking through May 31, 2010. The renewal of your license will be affected by continuing education tracking through the CE Broker system beginning with the June 1, 2008 through May 31, 2011 licensure cycle.
